Terms of Service

By creating an account or using oMemories, you agree to these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree to these terms, please do not use the app.

These terms constitute a legal agreement between you and oMemories.

oMemories is a personal memory preservation and sharing application that allows you to:

• Create and store personal memories with text and media
• Share memories with invited collaborators
• View and contribute to shared memories

The service uses end-to-end encryption (AES-256-GCM) to protect your content. Encryption keys are generated and stored on your device, so only you and your invited collaborators can read your content.

oMemories is rated 4+ (suitable for all ages) but requires:

• Users must be at least 13 years of age to create an account
• Users under 18 should have parental consent
• Parents/guardians are responsible for monitoring children's use

We do not knowingly collect information from children under 13. If you believe a child under 13 has created an account, please contact us immediately at bomayed@gmail.com.

To use oMemories, you must:

• Provide accurate and complete registration information
• Meet the age requirements stated above
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

Accounts are created and secured using your phone number. You are responsible for all activities that occur under your account.

You retain ownership of all content you create in oMemories (“User Content”). By using the service, you grant us a limited license to:

• Store your encrypted content on our servers
• Transmit your content to your invited collaborators
• Process your content as necessary to provide the service
• Review reported content for Community Guidelines compliance

You are solely responsible for your User Content and must ensure you have the right to share any content you upload.

You agree to follow our Community Guidelines and NOT to use oMemories to:

• Upload illegal content, including but not limited to child sexual abuse material (CSAM), terrorism content, or content that promotes violence
• Share sexually explicit or pornographic material
• Harass, bully, threaten, or abuse other users
• Share hate speech or content that promotes discrimination
• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Attempt to bypass security measures
• Share malware or malicious content
• Use the service for commercial purposes without permission

We reserve the right to remove content and suspend or permanently ban accounts that violate these terms.

To maintain a safe platform and comply with app store requirements:

• Users can report content that violates our Community Guidelines
• When content is reported, the reporter provides context about the violation
• Our Trust & Safety team reviews reports and takes appropriate action
• Content that violates our guidelines may be hidden or deleted
• Users who violate guidelines may receive warnings, temporary suspensions, or permanent bans
• All moderation actions are logged for accountability

Apple requires that we act on objectionable-content reports within 24 hours. We take this responsibility seriously.

When you share a memory with others:

• You remain the owner of the memory
• You can revoke access at any time
• You can remove participants from the memory
• Collaborators may add content to shared memories
• Collaborators cannot delete the memory or remove other participants
• Contributions by collaborators remain visible to other participants even after a user leaves

If you are the owner of a shared memory and wish to leave, you must transfer ownership to another participant first.

We take your privacy seriously:

• Your content is end-to-end encrypted using AES-256-GCM
• Encryption keys are generated and stored on your device
• Each memory has its own unique encryption key
• Only you and invited participants can decrypt your content
• We do not sell your data to third parties
• We do not show you advertisements
• In normal operation, oMemories cannot read your encrypted content; reported content may be reviewed for safety

We strive to provide reliable service, but:

• The service is provided “as is” without warranties
• We may experience occasional downtime for maintenance
• We reserve the right to modify or discontinue features
• We will provide reasonable notice of significant changes

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our liability is limited to the amount you paid for the service
• We are not responsible for content created by users
• We are not liable for data loss

You may delete your account at any time through the app settings.

We may terminate or suspend your account if you:

• Violate these Terms of Service or Community Guidelines
• Engage in fraudulent or illegal activity
• Abuse other users or the service
• Create content that violates our policies

Account deletion has a 30-day grace period during which you can sign back in to cancel. After the grace period:

• Your memories and contributions are permanently removed
• Your encryption keys are deleted
• Your encrypted data becomes permanently unreadable
• This action cannot be undone

We may update these Terms of Service from time to time. We will notify you of significant changes through the app or via email. Continued use of the service after changes constitutes acceptance of the updated terms.

These terms are governed by applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
